For observant families, a civil judgment of divorce is only half of the picture. New York law recognizes this. Under Domestic Relations Law § 253, a spouse seeking a divorce must generally verify that they have removed barriers to the other spouse's religious remarriage, and under DRL § 236B a court may consider the effect of such barriers when deciding equitable distribution and maintenance. Used correctly, these provisions create real leverage to resolve a withheld Get.
